From 1 January 2017, a particular medicine can be exported outside Slovakia only by its holder of marketing authorization, its manufacturer and/or an explicitly empowered wholesale distributor. The Slovak State Institute for Drug Control cannot prohibit the export of medicines.

Each holder of the marketing authorization of medicines fully or partially reimbursed from Slovak public health insurance (categorized medicines) has to have established, and operate, a special electronic system for the emergency ordering of such medicines from 1 April 2017. Ordered medicines must be delivered by a holder of marketing authorization in 24 hours, and by a wholesale distributor in 48 hours.

Wholesale distributors are authorized to supply human medicines fully or partially reimbursed from Slovak public health insurance (categorized medicines) solely to pharmacies (public or hospital), and to other wholesale distributors exclusively for the purpose of delivery of the medicines to pharmacies for ambulances, providers of emergency medical services and the armed forces.

Dividends paid to individuals from the profit reported for the periods starting as of 1 January 2017, will be subject to a withholding tax of 7%, which can be reduced under a double tax treaty.
Payment of dividends to a legal entity established in a country having a double tax treaty with Slovakia will further remain free from withholding tax.
Dividends related to the distribution of profit of different periods may have different tax treatments as the rules have been changed several times over the past years.

Amendment to the Act on Collective Bargaining in Slovakia – A new amendment to the Slovak Act on Collective Bargaining (effective from 1 September 2017) returns the possibility of extending a “representative” higher collective agreement to other employers (which were not party to such agreement) doing business in the same economic sector/industry. This means that the higher collective agreement will be applicable to such employers even without their consent.

In the past years, the EU competition law enforcement has been subject to major reforms in order to increase the deterrent effect of EU competition rules. These reforms reinforced the participation of private actors in the enforcement of EU competition law, by way of strengthening private enforcement and introducing leniency programmes on the national level. The Court of Justice of the European Union has established that any citizen or business has a right to full compensation for the harm caused to them by an infringement of the EU competition rules. The right to compensation is an EU right, but its exercise is governed by national rules. These often make it costly and difficult to bring antitrust damages actions. That is why in 2013 the European Commission proposed a Directive 2014/104/EU on Antitrust Damages Actions to remove the main obstacles to effective compensation, and to guarantee minimum protection for citizens and businesses, everywhere in the EU. Member States needed to implement it in their legal systems by 27 December 2016. To date, most of the CEE countries, including Hungary, Poland, Romania and Slovakia have successfully implemented the Directive. PETERKA & PARTNERS actively monitors these developments in the CEE region and welcomes the opportunity to advise clients and bring competition claims before the national courts.
