Requiring users to create a profile when shopping online has become common practice for many e-commerce traders.
However, the European Data Protection Board has raised concerns about the lawfulness of mandatory account creation and makes it clear: online stores and marketplaces cannot simply force customers to create accounts.
Mandatory registration is only justified in special circumstances, as the goals are to minimize data collection and give users more control over their personal information.

The appointment was confirmed by UBA Board Resolution No. 392 dated 8 January 2026. The UBA Committee on Labor Law is a professional platform uniting leading experts in the field and focuses on the development, interpretation, and practical application of the body of laws and rules of conduct governing labor relations in Ukraine. Labor law remains one of the most dynamic and socially significant areas of law in modern independent Ukraine, particularly in the context of economic transformation, European integration, post-war recovery, and the changing nature of employment. Effective and comprehensive regulation of labor relations is a key factor in shaping the country’s human and economic potential. The ongoing development of Ukrainian labor law aims to strike a fair balance between the interests of employers and employees, ensure legal certainty for businesses, protect fundamental labor rights, and align national legislation with international and European standards. In September, colleagues from all PETERKA PARTNERS offices gathered in Burgas, Bulgaria for a five-day team building. The event took place at the Primoretz Grand Hotel and brought together 150 people from 10 offices and 9 countries. The program included two days of workshops, a creative trust-building activity led by actors from the Sofia Theatre, and recognition awards presented by our global management. The gathering also marked the recent opening of our new offices in Ljubljana and Rzeszów. We sincerely thank everyone who helped make this team building an unforgettable experience. As of 31 March 2025, the Romanian Government introduced REGES ONLINE, the new General Register of Employees.
Key Highlights
• REGES ONLINE allows employees to access their employment data and download official extracts of their labour agreements.
• Originally, employers were required to register active contracts by 30 September 2025.
• On 19 September 2025, the deadline was extended — the new deadline is 31 December 2025.
• From 1 January 2026, the old REVISAL system will be fully replaced.
• Non compliance may result in fines of up to RON 20,000 (EUR 4,000).
What you should do next
1. Create and validate your account on REGES ONLINE (via ROeID/digital signature)
2. Collect and upload all relevant employment contract data
3. Adapt your HR and payroll procedures to align with the new platform
4. Train your team to ensure accuracy and consistency in reporting

Bulgarian Civil Procedural Code broadens mediation horizons in various disputes

23/07/2025 Bulgarian Civil Procedural Code broadens mediation horizons in various disputes
Recent amendments to the Bulgarian Civil Procedural Code have introduced an obligatory information meeting for mediation in various court disputes (e.g., matrimonial matters, matters of parental responsibility, liquidation of property, certain employment disputes, numerous monetary and non-monetary claims with a value up to EUR 12 780, etc.). The court shall oblige the parties to take part in an information meeting when it deems that the dispute is suitable for referral to mediation, taking into account all the circumstances related to it, including when certain criteria are met (e.g., lasting relations between the parties; interconnected disputes between the same parties; when the costs of the court proceedings may significantly exceed the material interest in the case, etc.). However, certain facts relieve the judge from the above obligation (e.g., acknowledgment of the claim, evidence of violence committed against a party to the dispute by the counter party or a risk to the life or health of a child or to their interests, etc.). Apart from the general benefits related to the out-of-court dispute resolution methods, positive effects of the newly adopted amendments are linked to certain financial aspects (i.e., the information meeting fee is covered by the court; if there is a settlement, up to 85% of the court fees paid by the parties will be reimbursed), as well as procedural efficiency elements (i.e., the court proceedings will not be suspended while the mediation is taking place, which reduces the risk of abuses of rights and does not affect the right to access to justice). The above amendments open up new opportunities and encourage the parties to a dispute to experience the high potential and empowering mechanisms of this out-of-court dispute resolution process.

PETERKA PARTNERS Ukraine acted as legal counsel to a leading European company that designs and manufactures machinery and complete turn-key lines for the processing and packaging of food products, in a complex transaction involving the EUR 2.7 million sale of a real estate complex. The complex, comprising several buildings and a land plot, was previously used in the client’s business operations.
Our services included:
• general legal analysis of the transaction under Ukrainian law;
• tax analysis of the deal;
• preparation of all necessary transaction documents;
• coordination of negotiations during the deal execution.
The deal’s structuring was particularly challenging due to legal restrictions on the repatriation of proceeds received from the sale of assets by a non-resident’s representative office in Ukraine.
Importantly, the buyer plans to use the acquired facility to relocate its production from front-line to safer regions of Ukraine, significantly contributing to the country’s economic resilience amid wartime challenges.
The project was led by Taras Utiralov, Stanislav Koptilin, Halyna Melnyk, Anastasiia Kusherets, Yuliia Sereda.
Український офіс PETERKA PARTNERS виступив юридичним радником провідної європейської компанії, що займається проєктуванням і виробництвом обладнання та комплексних рішень для переробки й пакування харчових продуктів, у складній угоді з продажу майнового комплексу вартістю EUR 2,7 млн. Комплекс, що включав кілька будівель та земельну ділянку, раніше використовувався клієнтом у господарській діяльності.
Наша команда надала такі послуги:
• загальний юридичний аналіз угоди відповідно до українського законодавства;
• податковий аналіз угоди;
• підготовка всіх необхідних документів для угоди;
• координація переговорів під час укладання угоди.
Структурування угоди було особливо складним через законодавчі обмеження щодо репатріації доходів, отриманих від продажу активів представництвом нерезидента в Україні.
Важливо, що покупець планує використовувати придбаний об’єкт для релокації виробництва з прифронтових до безпечніших регіонів України, що є суттєвим внеском у підтримку економічної стійкості країни в умовах війни.

PETERKA PARTNERS Ukraine successfully represented the Ukrainian subsidiary of a Denmark-based global manufacturer of electronic, mechanical, and electromechanical solutions in a complex tax dispute.
The court of appeal upheld the judgment of the first-instance court, fully siding with our client and putting an end to the dispute. The case concerned the proper tax treatment and accounting of the client’s standard business operations, where the tax authority’s interpretation significantly diverged from the company’s long-standing approach.
The favorable outcome not only eliminated the risk of additional tax liabilities in this matter but also mitigated the likelihood of future tax controversies, confirming the legality and compliance of the client’s reporting practices for key production-related activities.
The matter was led by Halyna Melnyk, Deputy Director for Ukraine and Tax Advisor at PETERKA PARTNERS. PETERKA PARTNERS Україна успішно представила українську дочірню компанію глобального виробника електронних, механічних та електромеханічних рішень із Данії у складному податковому спорі.
Суд апеляційної інстанції залишив у силі рішення суду першої інстанції, повністю підтримавши позицію нашого клієнта й остаточно поставивши крапку у спорі. Справа стосувалася податкового обліку типових господарських операцій клієнта, щодо якого податкова служба мала відмінне бачення, ніж підхід компанії.
Перемога у цьому спорі не лише усунула ризик донарахування податкових зобов’язань, а й знизила ймовірність подібних спорів у майбутньому, підтвердивши правомірність та відповідність вимогам законодавства обліку операцій, пов’язаних із виробничою діяльністю.
Проєкт супроводжувала Галина Мельник, заступниця директора українського офісу та податкова радниця PETERKA PARTNERS.

Peterka&Partners Bulgaria successfully represented an European air carrier in a tort claim submitted by a deported passenger against the client. The case involved unconventional legal issues in the areas of citizenship and the status of stateless persons, transportation of deported passengers, air security, border controls and an in-depth analysis of international regulations in the field of air transportation and the local regulation of seafarers’ competencies. The courts of first and second instance ruled in favour of the client, the appeal court decision is potentially subject to limited options for cassation appeal.

As stated in this previous legal article, Romanian High Court of Cassation and Justice (ÎCCJ) issued a landmark ruling on 16 September 2024, allowing phone recordings between employees or between employees and their employer to be used as evidence in labour disputes against the employer, even if the other party was unaware of, or did not consent to, the recording.
On 18 October 2024, the Romanian High Court of Cassation and Justice (ÎCCJ) published Decision no. 39/2024 containing the legal reasoning which led to the above-mentioned ruling. Please see below certain highlights from this decision which seem to bring more understanding of the court’s ruling.

Law 243/2024 on Consumer Protection in regards to the Total Cost of Credit and the Assignment of Receivables (“Law 243”) was published in Official Gazette no. 807/13.08.2024 and shall enter into force 90 days from the date of publication.
This law applies to legal relationships between consumers, non-banking financial institutions, and entities engaged in debt recovery activities in relation to consumer credit and establishes the rules for the protection of consumers against excessive interest rates with the aim of maintaining contractual balance and ensuring the integrity of the internal financial-banking market.
The status of a consumer acting for personal or family purposes is presumed and analysed in relation to the credit contract that falls under the scope of Law 243, and not to the debtor's entire activity.

PETERKA PARTNERS Ukraine successfully represented a world-renowned air freight and logistics group in a court dispute initiated by a former employee regarding the alleged unlawful termination of employment, reinstatement, and compensation for lost wages.
Our legal team developed a comprehensive strategy to safeguard the client’s rights and reputation against an unfounded claim challenging the legality of a dismissal during a redundancy procedure. The former employee also sought non-pecuniary damages and compensation for the period of unemployment.
In 2022, the court of first instance ruled in favor of our client, confirming that the dismissal complied with labor laws and that the employee’s claims lacked merit. In 2023-2024, both the court of appeal and the cassation court upheld this decision, reinforcing our client’s lawful position.
This case is particularly significant as it sets a strategic precedent for protecting the client’s internal decision-making processes, maintaining its reputation as an employer, and mitigating financial risks associated with employment disputes.
